PARTICIPANT TERMS AND CONDITIONS
Before we make arrangements for your flight, hotel, ground transportation, tour, cruise or other trip, or activity, service or product sold on this Website, we require that you, the Participant, sign this form; your signature will signify your agreement with the following terms and conditions:
New Horizon Tours ("NHT") acts as a sales agent for any airline, hotel, ground transportation, tour operator, cruise line, or other service or product provider named in your itinerary ("Suppliers"). NHT is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.
NHT assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under NHT's control. You hereby release NHT from all claims arising out of any problem covered in this paragraph.
You acknowledge and understand that: (i) airlines can increase their prices at any time before tickets are issued and that NHT has no control over issuance of tickets for tours; (2) airlines, cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms.
NHT has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, NHT recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, NHT recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release NHT from all claims arising out of any problem covered in this paragraph. You agree that the courts in Los Angeles County, California will be the exclusive jurisdiction for all claims brought by you or NHT, and you hereby submit to the personal jurisdiction of those courts.
ACTIVITIES & SERVICES
Reservations for Activities & Services, including activities, ground transportation, meal plans, VIP services, and all other transactions sold on this Website that do not include a accommodations or flights, are non-refundable, even if not used. If you have booked an Activity or Service, consult the service documents you will receive via email for important information and instructions. It is your responsibility to follow such instructions. You understand that discounted rates typically involve restrictions and that changing any aspect of my service arrangements, if permitted by the supplier, may result in the payment of additional money.
To confirm a reservation that includes flights and or accommodations, a non-refundable deposit is required. Your balance is not due until 60 days prior to departure (120 days for packages that include accommodations at ME by Melia Cabo or Villas). Cancellations 60+ days prior to departure are subject to a cancellation charge equal to the initial deposit amount or $100, whichever is greater, or forfeit of the non-refundable deposit (120 days for ME by Melia Cabo or Villa packages). Cancellations less than 60 days prior to departure will not receive a refund unless a replacement is found and a $100 name change fee is paid (120 days for ME by Melia Cabo or Villa packages). There will be no refunds for no-shows or cancellations received after departure. There is a $25 charge for returned checks.
You are responsible for coordinating with other Participants for their indicated occupancy. For example, if a Participant signs up for a Quad Occupancy package (four people per room) and one of the three other indicated roommates does not sign up or cancels, the remaining three Participants will be charged the current difference in price between the actual occupancy (Triple) and the intended or paid-for occupancy (Quad).
We recommend that you purchase Trip Cancellation insurance, which is not included with your travel package but may be purchased separately on this Website or from a third party. You represent that you have adequate primary medical insurance to cover any injury or damage to yourself while participating in The Cabo Agency sanctioned activities and understand that NHT relies upon this fact. You understand that your participation in certain activities may invalidate any insurance coverage you may have. You further represent that you have no medical or physical condition that could interfere with your safety or health while engaged with The Cabo Agency and related activities. You request and give your permission to NHT that you may be admitted to any hospital or medical facility for diagnosis and treatment. You request and authorize physicians, dentists, staff and nurses to perform any diagnostic procedures, treatment procedures, operative procedures and x-ray treatment reasonably required or appropriate.
In the event of strikes, labor disputes, fires, riots, wars, rebellions, acts of terrorism, weather, acts of God or other circumstances beyond the control of NHT which causes NHT to cancel the trip, NHT will use its best efforts to obtain refunds from Suppliers and apply Supplier refunds to tour Participant accounts, less a $200 per person service fee, and NHT shall be relieved of all obligations and liability to Participant. Participants who jeopardize the welfare of themselves or others will be removed from the trip at their own expense and will not receive any refund. NHT shall not assume responsibility for any claims, losses, damages, cost or expenses arising out of injury, accident or death, damage, loss, stolen or delay of baggage or other personal property, or delay inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether mental or physical. In the unlikely event that any part of the trip, travel services or entertainment becomes unavailable prior to departure or during the course of the trip, NHT reserves the right to modify, replace or cancel such service.
If initial reservation is made less than 60 days prior to departure, or if final payment is not received by 60 days prior to departure, price will be subject to air and hotel availability (120 days for ME by Melia Cabo, Villa and Custom packages). Flights selected by Participant are subject to change and are not confirmed until Participant's account is paid in full and Participant's flight is ticketed by the airline. Final flight information will appear on the Travel Itinerary that will be emailed to Participant and posted on the Participant's My Account page prior to departure. A $150 change fee plus any price difference applies if Participant requests and is granted a change from the flight originally selected by Participant.
NHT is not responsible for claims made by third parties, reps, promoters, travel agents, resellers or affiliates about the travel services provided. Participant is responsible for reading the content of this Website for information pertaining to travel services provided by NHT.
These Terms and Conditions shall be governed by the State of California without regard to choice of laws provisions, and the Participant agrees that such laws will govern any dispute of any sort that might arise between the Participant and NHT including your visit to this Website.
